Terms and Conditions
Enrolment
1.A
Spice subscriber to whom the invitation has been sent can become a Spice Club Spirit/ Royal member. There is no enrolment fee for joining the programme.
Points accumulation
1.The Spice Club Spirit/ Royal programme is valid till 30th April, 2009. This means that points will be given to subscribers based on the airtime usage and other specified criteria till 30th April, 2009. The redemption of points, however, will be allowed till 30th June, 2009. All subscribers’ points will lapse if they are not redeemed by 30th June, 2009.
2.Only Spice Club Spirit/ Royal member will be entitled to points based on the parameters specified. Spice subscriber can become a Spice Club Spirit/ Royal member by invitation only. Only Spice Club Spirit/ Royal members can avail of all benefits of the programme.
3.Spice reserves the right to change the eligibility criteria for membership to the rewards programme without any prior notice.
4.The calculation of points starts from the date of membership given. Spice’s computation of the Club Spirit/ Royal points shall be final, conclusive and binding on the members and is not liable to be disputed in any court of law or questioned.
5.Spice accepts no responsibility for any delay in allocating points to the customer’s Spice Club Spirit/ Royal account.
6.Spice may also award points based on any other parameter they deem for fit either for a specific period or event. Points can be earned only through participation. Points earned through participation are specific to the scheme.
7.Spice reserves the right for final judgement on whether or not to award points for any disputed bills.
8.A Spice Club Spirit/ Royal membership or points are not transferable.
9.In case of any delay in allocating points to Spice Club Spirit/ Royal member’s account, members shall intimate Club Spirit/ Royal Response Cell within 7 days from the receipt of their monthly bill. No requests shall be entertained thereafter.
10.In the event of the members taking a Spice connection in their own name in any of the other Spice circles, they are not permitted to transfer their points to their new account.
11.Similarly, points accumulated by Spice Club Spirit/ Royal members in any other circle cannot be transferred to Spice Club Spirit/ Royal members in Punjab circle.
Upgradation and Downgradation
1. Every customer has to keep a minimum usage ie. Basic Threshold Limit assigned to him to be a Club member.
2. Depending on the usage, a member can downgrade or upgrade as per the compliance of the subscriber to the BTL.
3. Any decision to upgrade and downgrade the member will be the sole discretion of Spice.
Points redemption
1.A subscriber shall qualify for redemption of any Spice Club Spirit/ Royal rewards point accumulated by him or her only if he or she accumulates a minimum of points within the period of membership. The minimum threshold of points required to start redeeming accumulated points for the various gifts in the programme catalogue is 250 points.
2. Points can be redeemed to a subscriber’s credit only in the manner prescribed under the Spice Club Spirit/ Royal programme and cannot be redeemed for cash.
3. Spice Club Spirit/ Royal points are redeemable only against products, vouchers or services as featured in the Spice Club Spirit/ Royal catalogue, and against any other products, vouchers or services as intimated from time to time by Spice under the Spice Club Spirit/ Royal programme. Redemption of Spice Club Spirit/ Royal points against any outstanding or other fees which are billed is not permissible.
4. If a Spice Club Spirit/ Royal member ceases to be a Spice subscriber, he/she must ensure that he/she redeems the accumulated reward points within 30 days of disconnection, provided the subscriber has cleared all his outstanding dues. The accumulated reward points shall lapse at the end of the 30 day period.
5. All products/vouchers featured in the Spice Club Spirit/ Royal rewards catalogue are subject to availability of the goods and supplier warranty at the time of redemption. Spice gives no warranty (whether expressly or implied) with respect to the products/services acquired, or their suitability for any purpose.
6. Additional copies of the Spice Club Spirit/ Royal catalogue will be made available to Spice Club Spirit/ Royal members at the rate of Rs. 50 per catalogue, subject to availability at any particular time.
7. Selection of products offered is & will be at the sole discretion of Spice & is liable to change without notice.
8. A member may redeem his points by requesting for a reward, by mailing an application in writing on a prescribed format and signed by him/her or through any other mode as mentioned in the catalogue.
9. Redemption orders from Spice Club Spirit/ Royal members, once given to Spice, cannot be cancelled, withdrawn or changed.
10.On redemption, the Spice Club Spirit/ Royal points would automatically be subtracted from the accumulated points in the Spice Club Spirit/ Royal member’s account.
11. Gift items, vouchers will reach Spice Club Spirit/ Royal member's within 4-6 weeks of the order, on a best effort basis. Notwithstanding this, Spice will not be held liable for any delay beyond this time period.
12.Period of validity of the vouchers and the places/outlets for redemption, will be decided by the programme partners and shall final and binding. The members should check the vouchers for the said details. Spice will not responsible for discrepancies thereafter.
13.Orders will be fulfilled in the sequence in which they are received & accepted by Spice. If a member does not have sufficient number of Spice Club Spirit/ Royal points, the order shall be deemed cancelled.
14. Spice reserves the right to cancel, change or substitute any reward item without any prior notice.
15. Spice will not be held responsible for products or vouchers stolen, damaged or lost in transit before delivery to programme members.
16.Spice will not be held responsible where any supplier of products offered to members withdraws, cancels, alters or amends those products.
17.Information supplied by the members on the redemption of certain rewards may be used by Spice or the service establishment that provided the rewards for administrative or marketing purposes.
18.Spice also reserves the right to modify, wholly or in part, this programme by any other programme or terminate the Spice Club Spirit/ Royal programme at any time & without any prior notice to the members.
19.Nothing contained herein will prejudice or affect the rules and regulations governing the use of Spice subscription. The terms and conditions will be in addition to, and not in substitution/derogation to the rules and regulations governing the use of Spice subscription.
20. Nothing herein amounts to a similar commitment or representation from Spice to conduct further, similar or other schemes.
21. The existence of a dispute, if any, regarding the products/services will not constitute a claim against Spice.
22. All instructions for participating in Spice Club Spirit/ Royal programme, form a part of the terms & conditions.
23. All pictures in the catalogue are indicative.
24. Any dispute arising out of Spice Club Spirit/ Royal programme, shall be referred to the sole arbitration of the arbitrator nominated by the CEO of Spice Communications Pvt. Ltd. And there shall be no objection to the appointment of any person as an arbitrator, on the ground that the said person has dealt with the matter at any stage or that he/she is an employee/ex-employee of Spice. In the event it becomes necessary to approach the Court of Law, the exclusive jurisdiction shall be vested in competent courts at Roopnagar (Punjab) only.
